Wills

Having a professionally drafted Will is invaluable in ensuring that your assets are inherited in accordance with your wishes and not under the rules of intestacy which would otherwise apply. It is also essential that Inheritance Tax is considered as the provisions of your Will can affect the future tax liability of your estate. Our Wills are prepared by a member of the Society of Trust and Estate Practitioners (STEP) in accordance with the STEP Code for Will Preparation (a copy of which can be found here) and we offer a personal service which is tailored to your own individual circumstances.

Trusts

Trusts have been used in estate planning for many years as a way in which to protect and manage family wealth and to reduce the liability to estate taxes in the long term. As well as advising upon the establishment of trusts both in lifetime and within your Will we can assist with all your associated requirements such as financial accounts, tax returns, day to day administration and ongoing advice for trustees, including tax advice. Our partners can also, where appropriate, act as professional trustees.

Probate

Administering the estate of a loved one can be a stressful and emotional time and the added burden of handling their legal and financial affairs can be daunting.

Probate is the process of administering someone's estate, their property, money and possessions after they have died.  This can be a time consuming and difficult process and families often look to appoint a professional firm to assist them.

At Jackson Stephen we are here to help you through this process, acting quickly and effectively to support you at every step of the way.

We are licensed to provide non-contentious probate services by the Institute of Chartered Accountants in England and Wales (ICAEW).

We pride ourselves on our close working relationships with our clients and the service that we provide sets us apart from our competitors.

For our existing clients we may have already provided Inheritance Tax planning during lifetime or drafted the person's Will, giving us a detailed knowledge of their financial affairs and the makeup of their estate.  This puts us in an excellent position when it comes to obtaining probate and carrying out their final wishes and is likely to lead to cost savings as against appointing a separate firm to undertake this work.

Furthermore, we find that for their beneficiaries it is reassuring to have somebody dealing with the estate who knew and worked with their loved one, sometimes over many years, who understands the family dynamics and, most importantly, who they trust.

Inheritance Tax Planning

Having already paid tax on income and gains during lifetime, we find that most people would like to minimise the amount of Inheritance Tax that their estate will suffer upon their death. Our experienced advisers can work with you and consider your own particular circumstances to devise short, medium and long term strategies to minimise the burden of this tax on you and your family’s wealth for years to come.

Lasting Powers of Attorney (LPAs)

This is a legal document which allows you to appoint someone you trust to make decisions for you should you lose capacity in future to make such decisions yourself. They come in two forms: Property & Financial Affairs and Health & Welfare and in connection with the latter we can prepare a Living Will where you express your wishes about how you want to be treated and cared for in certain situations. Once completed, it can be certified that you have capacity to give this power and are not acting in response to pressure from anybody else, we register the documents with the Office of the Public Guardian.
